PLAC CONDEMNS ARREST, DETENTION, AND CHARGES AGAINST OMOYELE SOWORE

Issued: 29 January 2025

The Policy and Legal Advocacy Centre (PLAC) unequivocally condemns the arrest and detention of Omoyele Sowore, a prominent human rights and democracy activist, by the Nigeria Police. We are deeply concerned about his charge to court on allegations of cybercrime – a clear misuse of legal provisions intended to combat genuine cyber threats.

Omoyele Sowore has consistently been a voice for the voiceless, championing causes of justice, accountability, and democratic governance in Nigeria. The latest action by the authorities to arrest, detain, and intimidate him under the guise of cybercrime allegations represents an alarming trend of using the law to suppress dissent and silence criticism. Such practices undermine the democratic values and fundamental human rights enshrined in the Constitution of the Federal Republic of Nigeria, including the rights to freedom of expression, peaceful assembly, and association.

PLAC is particularly disturbed by the apparent weaponization of the Cybercrimes Act to target activists, journalists, and civil society actors. This law was enacted to address legitimate concerns such as online fraud, identity theft, and other cyber offenses. Its misuse to stifle dissent is a dangerous precedent that threatens the rule of law and the space for civic engagement in Nigeria.

We call for the immediate withdrawal and dismissal of the charges against Sowore.

PLAC also calls on the Nigeria Police and all relevant authorities to:

  1. Immediately and unconditionally release Omoyele Sowore, as his incarceration is not only unjust but also represents a misuse of state power for personal purposes by State officials
  2. Desist from further misuse of the Cybercrimes Act and other laws to target individuals for their lawful exercise of constitutional rights.
  3. Respect and uphold the rule of law, ensuring that state institutions operate within the bounds of legality and do not become tools for suppressing opposing voices.
  4. Engage in constructive dialogue with civil society and activists to address grievances and strengthen democratic governance in Nigeria.

PLAC further urges the judiciary to remain vigilant against any attempts to use the courts to legitimize actions that contravene constitutional rights and international human rights standards. A democracy thrives when dissenting voices are heard and respected, not when they are suppressed and punished.

As Nigeria continues to navigate its democratic journey, it is essential to protect the freedoms and rights of all citizens, including those who challenge the status quo. The actions against Omoyele Sowore send a chilling message to activists and citizens who dare to hold power accountable. Such actions must be firmly rejected by all who value democracy and the rule of law.

PLAC stands in solidarity with Omoyele Sowore and all other individuals and organizations advocating for justice, human rights, and democracy in Nigeria. We remain committed to promoting the rule of law, accountability, and the protection of fundamental freedoms for all Nigerians.
