{"id":10507,"date":"2019-12-04T09:35:00","date_gmt":"2019-12-04T08:35:00","guid":{"rendered":"https:\/\/placng.org\/i\/?p=10507"},"modified":"2020-01-04T09:39:03","modified_gmt":"2020-01-04T08:39:03","slug":"senate-passes-the-public-procurement-act-amendment-bill-2019","status":"publish","type":"post","link":"https:\/\/placng.org\/i\/senate-passes-the-public-procurement-act-amendment-bill-2019\/","title":{"rendered":"Senate Passes the Public Procurement Act (Amendment) Bill, 2019"},"content":{"rendered":"<p><br>\n<br>\n<!--StartFragment--><\/p>\n\n\n<p>The Senate at its plenary session of\nWednesday, 4 December 2019 passed the Public Procurement Act (Amendment) Bill,\n2019<strong>(SBs 106,109, and 158)<\/strong> which seeks to review the mobilization fee\nfor contractors, create an e-procurement model and provide a time frame for\nprocurement processes. <\/p>\n\n\n\n<p>Presenting the report on the Bill, Sen.\nShuaibu Isa Lau (APC: Taraba), Chairman, Committee on Public Procurement\ninformed lawmakers that the Committee had received memoranda from key\nstakeholders including Ministries, Departments and Agencies (MDAs)&nbsp; as well as Non-Governmental Organizations\n(NGOs) before conducting a 2-day Public Hearing on Tuesday, 26<sup>th<\/sup> &nbsp;and Wednesday, 27<sup>th<\/sup> &nbsp;November 2019 to avail the public the opportunity\nto make oral presentations on the Bill.<\/p>\n\n\n\n<p>Sen. Lau highlighted the objectives of the\nproposed amendment to include:<\/p>\n\n\n\n<ol><li>The establishment of the National Council on\nProcurement (including its inauguration and Membership);<\/li><li>The establishment of an e-procurement model\nthrough the deployment of ICT to curtail interference in procurement systems;<\/li><li>The establishment of a Committee of Directors\nwhich shall be chaired by the Director-General of the Bureau of Public\nProcurement charged with the responsibility of issuing the <strong><em>\u201cCertificate\nof No Objection\u201d <\/em><\/strong>to local contractors;<\/li><li>Expanding the scope of application of the\nPrincipal Act to cover Ministries, Departments and Agencies (MDAs), National\nDefence and Security Agencies, the National Assembly and the Judiciary; and<\/li><li>The upward review of the mobilization fee for\nlocal contractors.<\/li><\/ol>\n\n\n\n<p>He also explained that the Committee had proposed\namendments to the following sections of the Public Procurement Act, 2007:<\/p>\n\n\n\n<ul><li><strong>Section 1,<\/strong> which deals with the <strong><em>Establishment of\nthe National Council on Public Procurement and its Membership;<\/em><\/strong><\/li><li><strong>Section 5, <\/strong>which deals with the<strong> <em>Functions of the\nBureau;<\/em><\/strong><\/li><li><strong>Section 6, <\/strong>which covers the<strong> <em>Powers of the Bureau;<\/em><\/strong><\/li><li><strong>Section 15, <\/strong>which deals with the<strong> <em>Scope of\nApplication;<\/em><\/strong><\/li><li><strong>Section 16,<\/strong> which deals with the <strong><em>Fundamental\nPrinciples for Procurement<\/em><\/strong>;<\/li><li><strong>Section 17, <\/strong>which deals with the <strong><em>Approving Authority<\/em><\/strong>;\nand <\/li><li><strong>Section 35 <\/strong>which deals with the<strong> <em>Mobilization Fee.<\/em><\/strong><\/li><\/ul>\n\n\n\n<p>Lastly, he noted that the Bill, if passed,\nwill allow for transparency and accountability in Nigeria\u2019s procurement\nprocesses.<\/p>\n\n\n\n<p><strong><em><a href=\"https:\/\/placng.org\/i\/wp-content\/uploads\/2020\/01\/Executive-Summary-on-the-Report-of-the-Public-Procurement-Act-2007-Amendment-Bill.pdf\">Click here to view the full Committee Report<\/a><\/em><\/strong><\/p>\n\n\n<p><!--EndFragment--><br>\n<br>\n<\/p>","protected":false},"excerpt":{"rendered":"<p>The Senate at its plenary session of Wednesday, 4 December 2019 passed the Public Procurement Act (Amendment) Bill, 2019(SBs 106,109, and 158) which seeks to review the mobilization fee for contractors, create an e-procurement model and provide a time frame for procurement processes.
