{"id":2320,"date":"2021-10-08T11:20:41","date_gmt":"2021-10-08T11:20:41","guid":{"rendered":"https:\/\/placng.org\/Legist\/?p=2320"},"modified":"2021-10-08T11:20:58","modified_gmt":"2021-10-08T11:20:58","slug":"executive-bill-seeks-to-enact-new-copyright-law","status":"publish","type":"post","link":"https:\/\/placng.org\/Legist\/executive-bill-seeks-to-enact-new-copyright-law\/","title":{"rendered":"Executive Bill Seeks to Enact New Copyright Law"},"content":{"rendered":"\n<p>On Tuesday, 28<sup>th<\/sup> September, an executive bill seeking to repeal the Copyright Act Cap C28 Laws of the Federation of Nigeria (LFN), 2004 and enact the Copyright Act 2021 passed second reading in the Senate. Following this, it was referred to the Committee on Trade and Investment. It was read for the first time on 7<sup>th<\/sup> July 2021. The bill seeks to replace the obsolete Copyright Act initially passed in 1988 and amended in 1992 and 1999. Its objectives are as follows: <\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>Protect the rights of authors to\nensure just rewards and recognition for their intellectual efforts;<\/li><li>Provide appropriate limitations\nand exceptions to guarantee access to creative works; <\/li><li>Facilitate Nigeria\u2019s compliance\nwith obligations arising from relevant international copyright treaties and\nconventions; and <\/li><li>Enhance the capacity of the\nNigerian Copyright Commission for effective regulation, administration, and\nenforcement of the provisions of this Act (bill). <\/li><\/ol>\n\n\n\n<p>Materials eligible for copyright include\nliterary, musical, artistic and audio-visual works, as well as sound recordings\nand broadcasts. However, eligibility criteria to copyright some of these\nmaterials are set out in the bill.<\/p>\n\n\n\n<p>A provision in the bill (clause 26)\nauthorises the accessible format of a work or subject matter to be produced for\nthe benefit of visually impaired or otherwise print-disabled persons, without\nthe permission of the of the owner of the copyright of the work in question.\nHowever, this can only be done under certain conditions, some of which include\nthat the maker must be an authorised entity, the accessible format is for the\nexclusive use of the beneficiary persons, the accessible format copy respects\nthe integrity of the original work, among others. <\/p>\n\n\n\n<p>The Senate Leader, Senator Yahaya Abubakar\n(APC, Kebbi) who led the debate on the bill, stated that it seeks to provide a\nholistic review of the policy and legal framework for copyright protection in\nNigeria. He identified the film, broadcast, music, fashion, book publishing,\nart and software industries as potential beneficiaries of a robust Copyright\nlaw. He noted that creative industries have witnessed tremendous growth but have\nalso been impaired by the weak mechanisms of the extant law and the\ngovernment\u2019s inability to sufficiently fund the Nigerian Copyright Commission.\nThe growth of the creative economy has seen the emergence of digital\ntechnologies which have made production and dissemination of creative works\nmore accessible and therefore open to global exploitation beyond national\nboundaries. <\/p>\n\n\n\n<p>In view of the identified issues with the\ncurrent Copyright act, the repeal and re-enactment bill seeks to reflect\ncurrent realities in order to strengthen the copyright regime in Nigeria, to\nenhance the competitiveness of the nation\u2019s creative industries. <\/p>\n","protected":false},"excerpt":{"rendered":"<p>On Tuesday, 28th September, an executive bill seeking to repeal the Copyright Act Cap C28 Laws of the Federation of Nigeria (LFN), 2004 and enact the Copyright Act 2021 passed second reading in the Senate.
