PLAC Production: Constitution Amendment Requires the Government to Direct Its Policy Towards Ensuring Food Security

This factsheet by PLAC provides an analysis of the Constitution of the Federal Republic of Nigeria, 1999 (Fifth Alteration) (No.34) Act, 2023, which makes Food Security a Fundamental Objective and Directive Principle of State Policy in Chapter two of the Constitution. It specifically alters section 16 of the Constitution and also creates a new section 16A, making it mandatory for the State to direct its policy towards strategies that guarantee food availability, accessibility, and affordability; continuous upgrade of food production, conservation and distribution methods; and food security measures that protect the country from compromise.

Generally, Fundamental objectives and Directive principles of State Policy in Chapter two of the Constitution require the government to recognise the social and economic needs of citizens but are not enforceable in court, unlike the fundamental human rights outlined in Chapter four of the Constitution. This means that this amendment is not enforceable in the court of law.
